ESTATE PLANNING AND PROBATE PRACTICE GROUP

Attorneys in this department work with clients to plan for the efficient and orderly transfer of property after death.This includes helping clients select methods to transfer their estate to achieve the lowest overall tax. Although tax planning is an important part of the process, attorneys do not lose sight of the fact that many personal decisions are involved in the estate planning process.

Our estate planners counsel clients regarding the potential benefits of revocable living trusts, trusts for children and other beneficiaries, powers of attorney, and living wills. The department also specializes in ways to capitalize on tax advantages and business planning for transfers of closely held businesses and ways to use irrevocable life insurance trusts to fund estate tax liability and provide estate liquidity. The attorneys closely follow all developments at the national and state level in order to keep informed of any legislative or court decisions that could impact estate planning and taxation.

In addition to the estate planning functions, the department also is experienced in estate administration, both in the probate courts and in transfers by trust. The department's attorneys handle both independent and supervised probate proceedings, and they represent beneficiaries' interests or the interests of personal representatives in adversary proceedings, such as will contests, will construction suits, and tax disputes before the IRS and in court.
