HEALTH CARE LAW PRACTICE GROUP
Legal developments continue to occur at a rapid pace in the health care field. These changes make the health care provider's mission more complex. Braun Kendrick Finkbeiner assists its health care clients in carrying out their functions and responsibilities effectively and efficiently.
The firm represents numerous health care clients throughout Michigan. These clients include hospitals, nursing homes, outpatient clinics, home health care agencies, clinical laboratories, industrial medicine centers, radiological and other imaging centers, physicians and other health care professionals, HMOs and PPOs, and a variety of health care joint ventures. The firm also represents several hospital associations and joint purchasing groups.
The firm handles a wide variety of health care law matters, such as corporate reorganizations and the forming and counseling of parent holding companies, health care foundations, for-profit subsidiaries, joint ventures, multi-institutional activities, and service contract arrangements. We advise nonprofit providers regarding the maintenance of tax-exempt status, unrelated business income issues, private inurement concerns, and charitable care requirements. We also assist our clients in health care financial issues, such as public offerings and private placements of bond issues, bank and institutional financing and equipment leases, and representation of providers in third-party reimbursement issues.
In the licensing and regulation area, we advise our providers about certificates of need and other federal, state, and regulatory issues, and we counsel our clients about mergers and the avoidance of antitrust law violations.
We advise institutional health care providers about numerous medical staff issues, including staff by-laws, credentialing, peer review, and disciplinary proceedings.
We also provide our clients with a wide variety of immigration services relating to the employment of foreign health care personnel.
Clients regularly consult us about other issues, such as JCAHO compliance, bioethics activities, medical records issues, Medicare fraud and abuse, informed consent, patient rights, pharmacy and narcotics issues, durable medical equipment activities, outpatient facilities and programs, and reproductive issues.
